This Consumer Privacy Policy describes the information that Mary Kay Inc. (“Mary Kay”) receives and/or processes (which may include collecting, organizing, structuring, storing, using, or disclosing) when you use or interact with Mary Kay websites, Mary Kay Independent Beauty Consultants or third parties as described herein.

We are committed to working with you to obtain a fair resolution of any complaint or concern about privacy. We cooperate with country data protection authorities if they believe that a privacy problem has occurred.

Uso de la Información
La información que se recolecta por medio directo de los Titulares a través de la respectiva autorización le permite a MARY KAY recolectar, almacenar, procesar, tratar, conservar, circular, compartir, consultar, actualizar, transmitir, transferir, suprimir y en general darle tratamiento a los datos personales para fines comerciales, promocionales, contractuales, legales, contables, fiscales, financieros, administrativos, logísticos, de mercadeo y en general para cumplir las actividades propias de su objeto social.
Las siguientes son formas en las que se puede usar la información que se recolecta del Titular:
- Envío de muestras y productos con previa solicitud.
- Desarrollo de nuevos y mejorados productos y servicios.
- Invitaciones a concursos, programas, ofertas o eventos.
- Creación y administración de una propia cuenta del Titular o de la Consultora.
- Proceso de pago de las compras o la utilización de los servicios para el Titular o en nombre de la Consultora.
- Identificación de transacciones fraudulentas y protección contra las mismas.
- Provisión de ofertas e información personalizada acerca de los productos y servicios de MARY KAY por medio de correo, siempre y cuando sea permitido por la ley.
- Desarrollo y provisión de publicidad personalizada de acuerdo a las preferencias de cada cliente.
- Análisis del uso y consumo de los productos, servicios y páginas web de Mary Kay Colombia.
- Registro y reporte de pagos.
- Registro de vinculaciones.
- Procesar y calificar información.
- Fidelización de clientes
- Gestión de relación con clientes.
- Implementación de estrategias de marketing.
- Gestionar el proceso de compra, pago, envío y devolución de pedidos realizados a través de Mi Negocio en Línea.

Temporalidad de la información recolectada
En el evento en el que el Titular revoque la autorización dada a MARY KAY para el tratamiento y manejo de sus datos personales, MARY KAY deberá terminar su uso de manera inmediata.
No obstante, en caso de considerarse necesario, los datos podrán permanecer en las Bases de Datos de Mary Kay Colombia S.A.S cuando se requieran para dar cumplimiento a un deber legal, así como cuando su tratamiento se limite a su conservación para fines históricos o estadísticos.
Agotada la finalidad para la cual fue recolectado el Dato Personal, MARY KAY deberá terminar su uso, y por ende adoptará las medidas pertinentes que aseguren su eliminación.
Acceso a la información:
Los Datos Personales que recolecte MARY KAY serán usados sólo en el ámbito de la finalidad y autorización concedida por el Titular del Dato Personal, por tanto, solo serán compartidos a terceros que requieran estos datos para la prestación de algún servicio a MARY KAY que sea necesario y que tenga la misma finalidad.
El Titular puede revisar, corregir, actualizar o suprimir la información personal que se ha suministrado. Así mismo, MARY KAY podrá ponerse en contacto con el Titular para solicitar que se revise la información, y de ser necesario la corrija o actualice.
Preferencias del acceso de la información:
El Titular tiene opciones para determinar la manera en que MARY KAY se podrá comunicar. En cualquier momento el Titular puede decidir que desea dejar de recibir los mensajes promocionales. Para ello, debe seguir las instrucciones que están incluidas en dicho mensaje bajo el título ’cancelar la suscripción’, o ponerse en contacto con MARY KAY para conocer información adicional sobre el material que desea dejar de recibir.
Si el Titular le entregó información directamente a la Consultora, debe contactarse directamente con ella para acordar lo respectivo al material y a las comunicaciones que desea o no recibir en el futuro.
En caso de que el Titular no quiera recibir información por parte de MARY KAY deberá comunicarlo de manera expresa de acuerdo con la presente Política. En todo caso el Titular autoriza de manera previa, expresa e informada a conservar la información que MARY KAY ha recolectado con las finalidades de elaboración de análisis, archivo y otras que puedan surgir, en el marco permitido por la ley.

Opt-Out: Our use of online tracking technologies may be considered a “sale” or “sharing” under applicable law. Visitors to marykay.com can opt out of being tracked by these third parties and manage their preferences by clicking “Do Not Sell or Share My Personal Information” link at the bottom of our website.

Information Sharing
The success of our business depends on your trust, and we do not sell your personal information to marketers outside of Mary Kay unless we have asked for and obtained your consent. We share your personal information only as described below and within Mary Kay.

Please note that we provide our service providers with only the personal information they need to perform their services and we require that they protect this information and not use it for any other purpose.

- Fulfill your product and service requests and answer your questions.

- Mail product samples, contact contest winners, manage payments or take other actions on our behalf.

- Where permitted by law, to protect and defend the rights and property of Mary Kay (including enforcing our Terms and Conditions and Agreements).

Aggregated and non-personal information: We may share aggregated information that does not identify you for general business analysis. For example, we may disclose the number of visitors to Mary Kay sites or services.
Pursuant to the DPF Accountability for Onward Transfer Principle, Mary Kay remains liable for the transfer of personal data to third parties acting as our agents if such third parties processes such personal data in a manner inconsistent with the DPF Principles unless we can prove we were not responsible for the event giving rise to the damage.
Seguridad de la información recolectada
MARY KAY se compromete a mantener la información de manera segura, de acuerdo con los procedimientos técnicos, administrativos y físicos para controlar la pérdida, el mal uso o la alteración de la información.
El acceso a la información está limitado a aquellos que la requieren de acuerdo con el desarrollo de los negocios de MARY KAY.
Cuando se entrega la información personal a terceros proveedores, se les solicitará que tengan en cuenta las medidas señaladas para la protección de los Datos Personales.
Cuando se recolecta o transmite información sensible, se utilizan métodos estándar para proteger dicha información.
Transferencia o transmisión de información
La información personal puede ser transmitida y/o transferida y/o almacenada y/o procesada en un país diferente a aquel en donde el Titular la entregó, y ser incluida en Bases de Datos de MARY KAY que no se encuentran en el país donde fue inicialmente recolectada, es decir, que podrá transferirse a matrices, filiales, afiliadas y/o subsidiarias, proveedores, contratistas, teniendo en cuenta el cumplimiento de la regulación aplicable; lo cual puede incluir a Estados Unidos de América. Se resalta que en Colombia se prohíbe la transferencia de datos personales de cualquier tipo a países que no proporcionen niveles adecuados de protección de datos, conforme al Art. 26 de la Ley 1581 de 2012.
Conforme con lo anterior, la Política Global de Tratamiento de Datos Personales Mary Kay aplica el mismo nivel de seguridad y protección de la información en todas las regiones donde se desarrollan negocios. La información puede ser temporalmente transferida a un vendedor, proveedor o a un tercero para proveer servicios de MARY KAY y/o a las Consultoras Independientes de Belleza.
De conformidad con la Ley, MARY KAY podrá compartir los datos personales con alguna entidad pública o administrativa en ejercicio de sus funciones o bien, por orden judicial.
Data Subject Rights
You may have certain legal rights, known as “data subject rights,” which may be exercised subject to certain limitations and/or restrictions. These rights include: (i) the right to access or correct your personal information, (ii) request rectification of any incomplete or inaccurate personal information, (iii) request deletion of your personal data; (iv) the right to opt out of the sale of your personal data; and (v) the right to ask for a copy of your personal information to be provided to you, or to a third party, in a digital format. We do not discriminate against individuals who exercise any of their rights described in our privacy policies.
There is no charge for exercising any of the data subject rights outlined in our privacy policies. However, if your request is unfounded, repetitive, excessive, or involves unnecessary costs, we may charge a reasonable fee. Alternatively, we reserve the right not to process your request in these circumstances. Information for Visitors from California: Mary Kay complies with the California Consumer Privacy Act (“CCPA”). If you are a California consumer, you have the right to request access to the personal information we have collected about you in the last 12 months. Subject to certain exceptions under the law, you have the right to access, request a copy, or request that we delete or correct any personal information we have collected from you. Mary Kay complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-US DPF as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and the United Kingdom (the UK including Gibraltar) transferred to the United States. Mary Kay has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern. This Privacy Statement was created specifically with you in mind. It describes the information we collect from Independent Beauty Consultants, how that information is used and protected, and the choices you can make about how we use and share your information.
We are committed to working with you to obtain a fair resolution of any complaint or concern about privacy. We cooperate with country data protection authorities if they believe that a privacy problem has occurred.
Information We Collect
In order to manage our business relationship with you as an Independent Beauty Consultant and provide you up-to-date product and business information for the efficient functioning of your Mary Kay business, Mary Kay collects the following information from or about you:

- Phone number and/or mobile number
- Date of birth
- Age
- Demographic information
- Family information, including marital status
- Government identification number
- Independent Beauty Consultant number
- Name of your recruiter, Independent Sales Director, Independent National Sales Director

- Payment information (such as a credit card or financial information in connection with your orders from the company)
- Commission history
- Customer Service call information
- Other information you may choose to share with us in connection to your Mary Kay business or which is shared about you by other Independent Beauty Consultants or consumers
How We Use This Information
As a Mary Kay Independent Beauty Consultant, you are in business for yourself but not by yourself. Generally, we use the information we collect from and about you to provide the products and services you and your customers request, to promote the efficient facilitation of the Mary Kay business opportunity, to comply with our legal obligations and contractual obligations with you, and for the business purposes set out below or other purposes for which you consent.
More specifically your information is used to:
- Send orders, product samples, rewards, products and information , products and information
- Tell you about products, services, promotions and benefits offered by or through Mary Kay
- Develop new products and services
- Enroll you in contests, programs, promotions or offers you request
- Provide you with information about other services that we have arranged through third parties for your convenience

- Process payment for purchases or other services
- Provide services to help you better serve your customers
- Protect against or identify possible fraudulent transactions
- Provide information regarding products and promotions from strategic partners and complementary businesses

Data Retention
Your personal information will be retained by Mary Kay only for as long as necessary to fulfill the purposes for which it was collected. This includes, without limitation, satisfying any legal, accounting, and reporting requirements. The appropriate retention period will depend on applicable legal requirements, the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process it, and whether those purposes can be achieved through other means. We give you choice regarding how we communicate with you.
Digital and Electronic Information
We send you promotional mobile or email messages that you have opted in to receive. Generally, you agree to receive these communications when you sign up as an Independent Beauty Consultant or when you join the on-line community available to Independent Beauty Consultants, Independent Sales Directors and Independent National Sales Directors.
You can stop receiving particular promotional mobile and email messages from Mary Kay and third parties who may send information on our behalf by following the instructions provided in any such message you receive. It may be necessary to continue to send you certain information electronically pursuant to the terms of your Independent Beauty Consultant Agreement and relationship with the Company.
Postal Mail
In connection with your status as an Independent Beauty Consultant we may mail you offers, product information and marketing tools that we believe are of interest to you. While certain materials are necessary to be sent to you by mail in conjunction with your status as an Independent Beauty Consultant, you can stop receiving certain promotional postal mail from Mary Kay. Contact Customer Service to update your preferences.
PLEASE NOTE: If you choose to stop receiving promotional messages from us, we will honor your request to the extent we can do so and still facilitate our agreements with you in relation to your Independent Beauty Consultant status. We will continue to send you service-related communications. We may need to maintain the information we have collected about you for record keeping, contractual requirements, analysis or other reasons to the extent required/permitted by law.
Access
We take steps to keep your personal information accurate. You can view, correct or update the personal contact information you provide Mary Kay. Most Mary Kay programs provide access to view or update personal information online including Mary Kay InTouch® and My Shop Web Sites. If you have any questions, you can contact Customer Service.
Sharing of Information
In general, we do not share personal information with marketers outside of Mary Kay. Our use of online tracking technologies may be considered a “sale” or “sharing” under applicable law. (See “Use of Cookies and Other Tracking Technologies” above.)
There are circumstances where special offers may be available to Independent Beauty Consultants by third-party companies and in those instances, we will only provide your information if we have clearly provided notice and asked for and obtained your consent. We may share your information with potential customers who have contacted the Company for a referral to an Independent Beauty Consultant, if allowed by law and/or if you give us specific permission to pass on this information to potential customers. We share information with other Independent Beauty Consultants in order to facilitate contractual obligations pursuant to the Independent Beauty Consultant Agreement, including to your recruiter, Independent Sales Director(s) and Independent National Sales Director(s), for the purpose of honoring our agreements with you and with them. We only provide the personal information needed in order to facilitate support for you and contractual compliance.
Third-Party Service Providers
We rely on third-party service providers to perform a variety of services on our behalf. In so doing, we may need to share your personal information with them. Please note that we provide our service providers with only the personal information they need to perform their services, and we require that they protect this information and will not use it for any other purpose. We may rely on a service provider to:
- Fulfill your product and service requests and answer your questions
- Host our sites and deliver our email and mobile messages
- Mail product samples, contact contest winners, manage payments or take other actions on our behalf
- Analyze data, sometimes combined with other sources, to send more targeted communications to you or, at your request, to your customers
- Conduct research and analyze data to improve our products, services and sites

- In order to provide first class Golden Rule Service around the globe, we may share personal information with other Mary Kay entities.
- Where permitted by law, to protect and defend the rights and property of Mary Kay (including enforcing our Terms and Conditions and Agreements).

We may share aggregated information that does not identify you for general business analysis. For example, we may disclose the number of visitors to Mary Kay sites or services.
Data Transfer
We may transfer, store and/or process personal information to Mary Kay databases, including those of other Mary Kay group companies, in countries other than where it was provided. Our Global Privacy Program requires the same high level of security and protection of personal information in all geographies with procedures and contracts in place to help ensure this is so. Mary Kay is proud to support the efforts of Mary Kay Independent Beauty Consultants through programs such as the Independent Beauty Consultant My Shop (“IBC Shop” or “Shop”), that allow Independent Beauty Consultants to connect with their customers through online tools that provide convenient round the clock access to information about Mary Kay® products and services offered by the Independent Beauty Consultant.
This IBC Shop Privacy Policy describes the information that your Independent Beauty Consultant collects about you through her Shop. It details how they use that information and the choices you can make about how this information is used.
When you provide your information to your Independent Beauty Consultant through her Shop, your information is placed in a secure location by Mary Kay on behalf of your Independent Beauty Consultant. Your information will be shared with Mary Kay but will not be shared with others without your permission except as described in Mary Kay’s privacy policies.
Information Collected on the IBC Shop
Information you provide to your Independent Beauty Consultant through her Shop may include:
- Name, email address, postal address
- Phone number
- Date of birth
- Skin type, skin tone and information on skin care and makeup preferences
- Other information about you, such as gender or product use preferences and/or behaviors
- Demographic information
- Preferences for future communications
While on the Independent Beauty Consultant’s Shop, cookies and other technologies are used to capture information about you and your use of the site. The following are examples of information that may be collected with these technologies:

- Site you visited before and after coming to our site

Your Independent Beauty Consultant uses the information you provide through her Shop for the following purposes:

- Facilitating the sale of products to you
- Managing product orders and delivery
- Understanding your product preferences and sending you information or product samples
- Sharing information with you about special offers, promotions or contests
- Scheduling appointments or providing information about hosting events
Mary Kay uses the information you provide through an IBC Shop for the following purposes:
- Facilitating the processing of payments for purchases or other services for or on behalf of your Independent Beauty Consultant
- Protecting against or identifying possible fraudulent transactions
- Supporting the Independent Beauty Consultant in identifying your preferences
- Analyzing the use of Mary Kay products, services, websites and applications s
- Understanding how you arrived at the IBC Shop and how you use the site so that we can make it better for you and your Independent Beauty Consultant
- Determining the effectiveness of the IBC Shop
- Enforcing the IBC Shop Terms of Use and otherwise managing and securing the site
- Asking you if you wish to participate in market research, and then contacting you if you give us permission
- Facilitating communication or information you have requested from your Independent Beauty Consultant or Mary Kay
The information you provide will be used solely for the purposes for which it was collected. Your information will only be used for another purpose if that other purpose is compatible with the original purpose or we obtain your separate consent to use your information for any additional purposes at that time.
Your Choices and How to Access Your Information
When you use the IBC Shop, you are providing your information to the Independent Beauty Consultant. Mary Kay will also have access to your information and process it for the purpose of providing services to you and your Independent Beauty Consultant and for our own limited purposes, as described in the “How This Information Is Used” section above. However, rest assured that we treat your information provided through the IBC Shop in accordance with the standards set forth in this policy as well as our Consumer Privacy Policy and our Global Privacy Statement. Please refer to those privacy policies for further information.
Generally, individuals who provide information through the IBC Shop can follow the opt out or unsubscribe instructions provided in any messages, log into their account and update the communication preferences in the account settings, or contact Mary Kay directly to request to stop future communications directly from Mary Kay in connection with the IBC Shop. You will need to contact your Independent Beauty Consultant directly in order to request that your Independent Beauty Consultant not forward or otherwise send information to you that is not sent directly by Mary Kay through the IBC Shop program.
You can review, correct or update the personal contact information you provide through the IBC Shop by logging into your account and managing your account preferences. You also have legal rights; these are described in the "Data Subject Rights" section. Cookies and Tracking Technologies
How we use Cookies, Pixels and other Technologies: Mary Kay uses cookies and various technologies to provide you a richer and more personalized consumer experience. These technologies collect and store personal data about you and your online behavior.
Opt-Out: Our use of online tracking technologies may be considered a “sale” or “sharing” under applicable law. Visitors to IBC Shop sites can opt out of being tracked by these third parties and manage their preferences by clicking “Do Not sell or Share My Personal Information” link at the bottom of our website.
